The Chamber of Deputies overrode the Senate on 9 September and the President signed on 17 September 2026. The changes come in three waves. It has no number in the Collection of Laws yet, so the dates may still move.
After publicationfirst day of the following month, most likely 1 Dec 2026
Bigger minor buildings by a house or cottage: up to 60 m², 5 m high, an attic allowed on top of one floor. The 2 m distance and 50 % rain soak-up stay.
Residential blocks up to 500 m² footprint and 4 floors above ground, housing only, become simple buildings.
Retaining walls between plots up to 1.5 m, paved areas by a house up to 60 m², and insulating a house without a permit (if stability, appearance, use and fire safety are not affected).
Neighbours get 10 days to object instead of 15. In buildable areas the law presumes in favour of the builder (§ 194).
A permit can be valid for up to 7 years.
1 Jan 2027second wave
Permit by silence (fikce povolení): if the office does not decide on a simple building in the fast track within 30 days, it counts as permitted (§ 212a).
Authorities can no longer extend their 30-day deadline. Silence still means consent.
Objections must give a reason and the extent of impact. A permit can be reviewed only within 3 months of becoming final.
The appeal body may no longer cancel a decision and send it back; it must decide itself.
1 Jan 2028third wave
Municipal building offices close; regional development offices and their local branches take over.
Opinions now issued by separate authorities (health, nature, heritage) will come from the building office itself: one procedure, one office, one decision.
Based on the approved text as summarised by bezrealitky.cz and the law firm Frank Bold, and on the ministry's website novystavebnizakon.gov.cz (all in Czech). We will switch the guide to the new rules once the amendment is published in the Collection of Laws.
